1. Acceptance of Terms
By accessing or using Buildero ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service. These terms apply to all visitors, users, and others who access the Service.
2. Description of Service
Buildero is a cloud-based construction management platform that provides AI-powered tools for project management, crew scheduling, time tracking, estimating, invoicing, and client communication. The Service is available via web browser and mobile devices. Features and functionality may vary depending on your subscription plan.
3. User Accounts & Registration
To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. You must be at least 18 years of age to create an account.
4. Subscription & Billing
Buildero offers subscription plans billed on a monthly or annual basis. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Refunds are not provided for partial billing periods. We reserve the right to change pricing with 30 days' notice.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not: (a) use the Service to transmit harmful, fraudulent, or illegal content; (b) attempt to gain unauthorized access to any part of the Service; (c) interfere with or disrupt the integrity of the Service; (d) use automated systems to scrape, mine, or extract data from the Service without written permission; (e) sublicense, resell, or redistribute the Service to third parties.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by Buildero and are protected by international copyright, trademark, and other intellectual property laws. Your data remains your property. By uploading content to the Service, you grant Buildero a limited license to process and store that content solely for the purpose of providing the Service.
7. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.
8. Limitation of Liability
To the maximum extent permitted by law, Buildero shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
9. Termination
We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately. You may request an export of your data within 30 days of termination. After 30 days, we reserve the right to delete your data in accordance with our data retention policies.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in San Francisco County, California.
